A London Stock Exchange listed extractive industries company approached Diligence having lost key mining licenses to an unknown competitor in a Central Asian republic. Diligence were tasked to assist in the effort to have the licenses restored.

Diligence’s investigation ranged across 3 continents and built a picture of deliberately obscured beneficial ownership which when penetrated revealed unhealthy proximity to the leading faction in the Republic concerned. Diligence then worked with the retained Legal and Public Relations companies to reveal the links and appeal to both the International Courts and in-country opposition. Ultimately the usurper was dis-enfranchised and Diligence’s client’s licenses were reinstated.

 

Technical Services - Brazil/Nigeri/China

A leading US Law Firm approached Diligence regarding assistance in securing technical data from ‘hard to access’ situations such as high threat countries and hostile situations. The US Law Firm had been retained by a large multi-jurisdictional company with offices around the world. This firm was undertaking a review of certain procedures and practices and required that subsidiary companies provide data as requested. Diligence was able to provide in-house experts to both visit and recover data from the companies and countries in question in a fashion that was legally compliant with a view to the possible requirement for subsequent legal action. Diligence was also able to represent and interrogate the data as required and instructed by the Law Firm as well as being able to advise what was possible and the extent to which data had been deliberately obscured. All of this was achieved with Diligence staff and in a fashion that did not put the Law Firm’s into potentially hostile situations.
